General Terms

General terms and conditions for the rental of apartments in the Gomeralounge and in La Galeria, Valle Gran Rey, La Gomera.

The guest of the Gomeralounge or La Galeria accepts the following general terms and conditions:
    
1. Scope of application of the general terms and conditions and scope of services

1.1 These General Terms and Conditions apply to the rental of an apartment in the Gomeralounge or in the La Galeria in Valle Gran Rey by the Gomeralounge as well as to the rental of an apartment in these houses through a third tour operator or travel agent.

1.2 The contractual partner is Gomeralounge, unless a third party has concluded another contract with the tenant in consultation with Gomeralounge. 

1.3 Gomeralounge shall make the rented apartment with the facilities contained therein (according to the inventory list) available for use during the booking period. There is no entitlement to the use/use of the other facilities located in the Gomeralounge and/or La Galeria. The wellness area on the roof of the Gomeralounge with sauna and jacuzzi as well as cosmetic and massage offers are additional services which can be booked for a fee on an individual basis.

2. Conclusion of the contract

2.1 The Gomeralounge website is for information purposes only and does not constitute a binding offer. The rental agreement shall not be deemed to have been concluded bindingly until a booking has been made by e-mail, telephone and/or in writing and a written confirmation of the booking (confirmation of reservation) has been issued by Gomeralounge by e-mail and/or in writing.

2.2 The data contained in the reservation confirmation are binding, in particular the categories of the apartments and thus the apartment prices. There is no entitlement to a specific apartment unless it is expressly stated in the reservation confirmation as an exception.

2.3 The hotel's own internet connection and the TV connections in the apartments are not part of the contract. They are regarded as free additional services to which there is no claim in the event of possible disruptions.

3. Cancellation conditions

3.1 The price stated in the reservation confirmation is binding. Upon receipt of the reservation confirmation, a down payment in the amount stated herein shall become due. The balance must be paid on arrival at the Gomeralounge.

3.2 In the event of cancellation of the booking, the Gomeralounge charges:

up to 30 days before arrival 30 % of the total price (without final cleaning),
up to 14 days before arrival 50 % of the total price (without final cleaning)
from the 14th day before arrival the total price (without final cleaning)

4. Rights and obligations of the contracting parties

4.1 All information regarding the booking must be truthful and complete. 

4.2 As a rule, the apartment can be occupied from 2 p.m. on the day of arrival and must be vacated no later than 11 a.m. on the day of departure. Arrival and departure are at your own risk.

4.3 The Gomeralounge is an apartment building, not a hotel, so that a reception desk is available to house guests at certain times of the day for seasonal reasons.

4.4 During the rental period, the tenant must ensure that the rented apartment remains clean and in proper condition. Bed linen is changed once a week, towels every 3 - 4 days (in La Galeria every week). Beach towels are not provided. Additional services such as jacuzzi, sauna, massages etc. can be provided at extra cost on request.

4.5 The Gomeralounge undertakes to hand over the apartments to the kitchen in a proper condition and with the equipment customary in the country. In the event of gross misuse or improper use of the equipment, the Gomeralounge may demand reimbursement of costs or damages or terminate the contract without notice.

4.6 The loss of an apartment key must be reported immediately and will be invoiced at € 50. 

4.7 Gomeralounge accepts no liability for service disruptions that are beyond its control. These include but are not limited to

Disruptions to local supply and disposal services (e.g. water - including temperature - , electricity, telephone lines, Internet and/or SAT reception, etc.) Disturbances due to force majeure (e.g. weather etc.) Impairments resulting from neighbouring disturbances (e.g. noise nuisance from neighbours or tourists outside the house, sea noise, animal sounds, etc.) Defaults in performance, the liability of which is excluded under domestic law

4.8 If Gomeralounge is unable to perform its services due to force majeure, it undertakes to provide the guest with alternative accommodation. A claim for damages cannot be derived from this.

4.9 In the event of violations of the house rules, Gomeralounge is entitled to terminate the rental agreement immediately. In such a case, the tenant is not entitled to a refund of the costs incurred or the rental payment.
